In-depth Explanation on EN 71-1:2005 + A9:2009 Safety of Toys, Mechanical and Physical Properties

 

 

REQUIREMENTS ON PACKAGING

 

-          Plastic bags with an opening perimeter greater than 380 mm shall have an average thickness of 38 μm or more

 

-          The requirement above does not apply to:

 

i)                    Shrunk-on film packaging;

ii)                   Perforated bags which have a minimum of 1% of removed area over any area of 30 mm x 30 mm

 

 

 

WARNINGS AND INSTRUCTIONS FOR USE

 

 

Clause 7.1

 

i)                    CE Mark (at least 5 mm in height)

ii)                   Name and address of the European importer

iii)                  Retain statement* (not necessary if the labeling is on the toy itself)

 

* Example of "retain statement": Please retain this information for future reference

 

 

Clause 7.2

 

If small part exists before and after abuse tests for a toy for over 3 years, then the toy should bear a warning, for example:

  

“Not suitable for children under 3 years due to small parts”

 

Remark:

 

1.       The warning is not needed if the toy is considered to be manifestly unsuitable for children under 36 months.

2.       If a small part exists before and after abuse tests for a toy for under 3 years, the toy fails, even there is a warning.

 

Same case for Long cord warning

 

“Not suitable for children under 3 years due to long cord”

 

 

Clause 7.3 Latex balloons

 

Latex balloons/Natural latex balloon

 

The packaging of latex balloon/natural latex balloon should bear the following warning:

 

“Warning! Children under eight years can choke or suffocate on uninflated or broken balloons. Adult supervision required. Keep uninflated balloons from children. Discard broken balloons at once.”

 

Natural latex balloon

 

The packaging of natural latex balloons should indicate:

 

“Made of natural rubber latex”

 

 

Clause 7.4 Aquatic toys

 

Aquatic toys and their packaging should bear the following warning:

 

“Warning! Only to be used in water in which the child is within its depth and under supervision”

 

i)                     The warning on the toy should be indelible

ii)                   The warning on the toy should be in a colour which contrasts with the body of the toy.

iii)                  The minimum height of letters should be 3 mm

iv)                  The marking on inflatable toys should be no more than 100 mm from one of the air inflation

 

Remark: No advertising copy or graphic should state or imply that the child will be safe with such a toy if left unsupervised.

 

 

Clause 7.5 Functional toys (e.g. Toy pop-corn maker)

 

Functional toys or their packaging shall bear the warning:

 

“Warning! To be used under the direct supervision of an adult.”

 

In addition, the followings should accompany the toy:

 

i)                     working instruction

ii)                   precautions to be taken by the user

iii)                  a statement which warns that failure to take the above precautions would expose the user to the hazards (the corresponding hazards the functional toy  are needed to be specified) normally associated with the appliance or product of which the toy is a scale model or an imitation

iv)                  a statement indicating that the toy should be kept out of the reach of very young children

 

 

Clause 7.6 Functional sharp edges and points

 

For toys intended for children of over 3 years and functional sharp edge and/or point exist, then functional sharp edge warning and/or functional sharp point warning should appear on the packaging and in the instructions for use accompanying the toy when appropriate:

 

Example of functional sharp edge warning:

 

“This toy contains function sharp edge”

 

Example of functional sharp point warning

 

“This toy contains function sharp point”

 

Remark: functional sharp edge and point are not allowed for toys intended for children below 3 years of age, even there are warnings.     

 

 

Clause 7.7 Projectile (e.g. toy gun)

 

If a projectile toy can discharge an object other than that provided with the toy (e.g. pencil), then the instructions for use should draw attention to the hazards of using missiles other than those supplied or recommended by the manufacturer.

 

Example of the warning:

 

“Do not use missiles other than those supplied or recommended by the manufacturer”

 

Projectile toys capable of discharging a projectile (e.g. bullet) with a kinetic energy greater than 0.08J should be accompanied by the following warning:

 

“Warning! Do not aim at eyes or face.”

 

 

Clause 7.8 Imitation protective masks and helmets (e.g. toy fireman’s helmets)

 

Toys that are imitation of protective masks and helmets and their packaging, if any, should bear the following warning:

 

“Warning! This is a toy. Does not provide protection”

 

 

Clause 7.9 Toy kites

 

Toy kites and other flying toys with cords exceeding 2 m materially linking the toy to the child shall bear the following warning:

 

“Warning! Do not use near overhead power lines or during thunderstorms.”

 

Remark: the warning is not necessary if the cord length is less than 2 m.

 

 

Clause 7.10 Roller skates and toy skateboards

    

Roller skates, inline skates and skateboard for children offered for sale as toys should bear the warning:

 

“Warning! Protective equipment should be worn. Not for children with a body weight of more than 20 kg.”

 

Remark: The above products which are designed for bearing a body weight of more than 20 kg are not considered as toys.

 

Moreover, the instructions for use should:

 

i)                     contain a reminder that the toy is to be used with caution since it requires great skill, so as to avoid falls or collisions causing injury to the user and third parties

ii)                   contain indication as to recommended protective equipment (helmets, hand/wrist protection, gloves, knee-pads, elbow-pads, etc.) 

 

 

Clause 7.11 Toys intended to be strung across a cradle, cot, or perambulator (e.g. toys linked by a cord with hooks at both ends, for being strung across a baby cot)

 

Toys intended to be strung across a cradle, cot, or perambulator by means of strings, cords, elastics or straps should bear the following warning:

 

“Warning! To prevent possible injury by entanglement, remove this toy when the child begins to push up on hands and knees.”

 

 

Clause 7.12 Liquid filled teethers

 

Liquid filled teethers should be accompanied by the following instruction:

 

“Cool only in a domestic refrigerator, do not place in the freezer compartment.”

 

Remark: the above requirement does not apply to teethers that do not contain liquid

 

 

Clause 7.13 Percussion caps specifically designed for use in toys

 

The packaging of percussion caps should carry the following warning:

 

“Warning! Do not fire indoors or near eyes and ears. Do not carry caps loose in a pocket.”

 

 

Clause 7.14 Acoustics (toys designed to produce sounds)

 

If a toy produce a C-weighted peak emission sound pressure level exceeding 110 dB(C), the toy or their packaging should bear the following warning:

 

“Warning! Do not use close to the ear! Misuse may cause damage to hearing.”

 

Remark: for “other toys”:

                              110-115 dB(C)           Put warning

                             > 115 dB(C)               FAIL

 

For toys using percussion caps add:

“Do not fire indoors!”

 

 

Clause 7.15 Toy bicycles

 

Toy bicycle should carry a warning:

 

“Warning! A protective helmet should be worn when cycling!”

 

In addition,

i)                     instructions for use should contain a reminder that this bicycle is not suitable for use on public highways.

ii)                   Parent or carers should ensure that children are properly instructed in the use of the toy bicycles, particularly in the safe use of the baking systems

 

 

Clause 7.16 Toys intended to bear the mass of a child (e.g. tricycle, toy chair)

 

Toys that due to their construction, strength, design or other factors are not suitable for children over 36 months should carry a warning (at the point of sale of the product), for example:

 

‘Warning! Not to be used by children over 36 months”

 

together with a brief indication of the specific reason calling for this restriction (e.g. insufficient strength).

 

Example of a full warning:

 

“Warning! Not to be used by children over 36 months due to insufficient strength”

 

Remark: The warning above is for toys for under 3 years, and not for the age group of over 3 years. This is because the warning is to address the case where a child of over 3 years sits/stands on the toy with a result that the toy collapses. The toy collapses because the strength of the toy is originally designed for children under 3 years and not for children of over 3 years.

 

 

Clause 7.17 Toy comprising monofilament fibres (e.g. monofilament plastic whiskers on a toy stuffed cat) 

 

Toys comprising monofilament fibres of straightened length greater than 50 mm and attached to a fabric base should be labeled as follows:

 

“Caution! Not for children under 10 months due to long hair”

 

Remark: If the monofilament fibres have length equal to or less than 50mm, then the warning above is not necessary. Also, if a toy labeled “All Ages”, it contradicts to the warning above”

 

 

Clause 7.18 Small balls

 

If small ball exists before and after abuse tests for a toy for over 3 years, then the packaging of toys should bear a warning, for example:

  

“Warning! Not suitable for children under 3 years because of small ball(s)”

  

Remark:

 

1.       The warning is not needed if the toy is considered to be manifestly unsuitable for children under 36 months.

2.       If a small ball exists before and after abuse tests for a toy for under 3 years, the toy fails, even there is a warning. 

 

 

Clause 7.19 Toy Scooters

 

Toy scooters intended for children with a body mass of 20 kg or less should carry the statement ’20 kg max”

Toy scooters intended for children with a body mass of 50 kg or less should carry the statement ’50 kg max”

 

The warnings:

 

“Warning. Protective equipment should be worn.

Not for children with a body weight of more than 20 kg” (or, as appropriate, “of mor than 50 kg)

 

should appear on the packaging, if there is one, and in the instructions for use.

 

The instructions for use should contain a reminder that the toy should be used with caution, since it requires great skill, so as to avoid falls or collisions causing injury to the user and third parties, they should also, as appropriate, include information such as:

 

-          warnings indicated above;

-          how to safely fold or unfold foldable scooters;

-          necessity to pay attention that all locking devices are engaged;

-          dangers of using it on public highways; and

-          recommendation to use protective equipment such as helmet, gloves, knee-pads and      elbow pads.
